Our Areas of Practice

If you were injured in a car accident, there are elements to be proved beyond a preponderance of the evidence, to receive compensation.

California conveys ‘strict’ liability upon dog owners. Additionally, there may be other issues which help the injured party.

Motorcycle Accident

Many motorcycle accidents occur because the automobile driver failed to reasonably observe their surrounding.

Nursing Home Injury

Elder abuse involves the intentional or neglectful act(s) by a caregiver or “trusted” individual, that did (or may) lead to harm of a vulnerable elder.

Commercial Vehicle Accident

Injuries caused from being hit by a commercial vehicle can be greater, but companies usually must carry higher insurance coverage polices

Bicycle / E-bike Accident

If you were hit by an automobile or commercial vehicle while riding your bicycle or e-bike, call our office today so we can help protect your rights

Construction Site Accident

Whether the injury occurred on or near a work-site, or whether the injured person was an employee or a bystander, we can help.

If there is a criminal case against the person that caused the death, it may be strategically valuable for a civil suit to follow the criminal action.

Don’t allow insult to be added to injury… literally.

It is settled case-law that you will only get (what is referred to in the industry as) “one bite at the apple”. If your case is not handled correctly, you are stuck with the outcome forever. Although people have the right to appeal, not only does there need to be legal grounds for an appeal, but appeals are very expensive and can take years. Handling your case right the first time is the only option. The injuries suffered in an accident can force the injured person to have to endure a life that is much lower in quality. This can be due to not only having to deal with the pain of the injury on a daily basis, but the person may suffer limited mobility for an extended amount of time (if not for the rest of their life). Therefore, it is vital that you receive the optimum outcome on your case the first time.

With over 35 years of experience as Personal Injury attorneys, we know what you are likely going through. The injured person (as well as the family) may be experiencing confusion, anxiety, or stress. We can answer your questions and handle this situation for you, so you can focus on getting better.

You have questions which may include:

  • Who do I call first and what do I do first?
  • Do I need to be careful about what I say to the insurance company, family, friends?
  • Should I go to the Hospital? Should I take (or have taken) an ambulance?
  • What are the “do’s” and “dont’s” of a successful personal injury case?
  • How do I pay for medical treatment or medical bills?
  • Do I need to use an attorney? Will it cost me anything to use an attorney? What are the pros and cons of using an attorney?
  • How long will it likely take to settle my case?

Most importantly – we cannot stress enough the importance of talking with an attorney as soon as possible.

Whether it is us/our law-firm, or any other law-firm, if you (or your loved one) has been seriously injured, it is vital that you do not speak with the other side’s insurance company, or anyone, before speaking with an attorney. And we recommend this whether you end-up using an attorney or not.

You cannot out-smart the insurance company, they’ve been doing this for too long, have much more experience than you in the area, and have more knowledge and resources than you.

This is not to say that insurance companies are evil or trying to take advantage of you. However, that being said, Insurance companies (even your own) are looking out for their own financial interests and the interest of their stock-holders, not yours.

When a call is made to an insurance company (such as if you or one of your family members calls an insurance company), almost always the caller receives the outgoing message that the call is being recorded for the purpose of quality assurance. However, even though the ‘purpose’ of recording the call is supposedly ‘quality assurance’, you are now put on notice that your call is being recorded (as required by California law).

And although it may seem like the adjuster you might speak with is friendly and seems reasonable, don’t be fooled. Things you say (or don’t say), or things you do (or don’t do) can and will be used against you.

As you speak with the Insurance company’s adjuster (or sometimes referred to as ‘file-manager’ to make it less obvious), it may even seem like the person you speak with is sympathetic to your injuries. You may even believe the person you speak with from the other side’s insurance company is ‘on your side’ and is likely to give you a good offer to compensate you without a fight. However, all too often the injured person talking with the insurance company is rudely introduced to the harsh reality that the insurance company (which may include your very own insurance company) is looking out for their own financial interest and the interests of their stock-holders, not yours. And what you thought was going to be a civil transaction, where you would receive a reasonable settlement, turns out to be a ridiculous ‘low-ball’ offer to you. And because of statements you’ve made (or failed to make), which can now be proven by recorded calls, and/or because of your actions (or your failures to act), you are left with no option other than having to accept their unreasonable offer where you unfairly do not receive the compensation you deserve.

A few initial concepts you should be aware of:

There are a few concepts that must be understood. First, injury to the ‘person’ is separate from damage to ‘property’. Second, although ‘pain and suffering’ is constantly shoved together, they are separate. With regard to injury to the ‘person’ the injured may be compensated for the ‘suffering’ s/he endures as a result of having ‘pain’ inflicted upon him/her. Additionally, if the injuries the injured person suffers require adjustments, corrections, or therapy to his/her physical body, you should be compensated for that as well. Furthermore, if the event was traumatic enough, the injured person may require psychological therapy as well. Also, if the injured person is forced to miss work as a result of the injuries, s/he may be compensated for that. There may also be existing medical bills and possibly future medical treatment that will need to be paid for. All of these factors must be taken into consideration if you are to be protected correctly.

Choosing the correct medical professionals for your situation is also critical.

Deciding on and choosing the best medical professionals to help you in your situation can also be challenging. Researching medical professionals that will treat you correctly, (which will also affect your case), can be a daunting task. What kind of formal education have they had in the area you need treatment in? How much experience does the medical professional have treating your type of injuries? Have they made the investment required to acquire the necessary equipment in their office to help you ‘in-house’ or do they need to send you someplace else? Do they have a history of success treating your type of injuries? How pleased have their former patients been with them? Do they have a good track-record of competent and reasonable follow-up, or do they have a history of leaving their patients wondering what’s going on? For over 35 years the Law Offices of Gregory A. Montegna constantly makes sure you are connected with the best medical professionals to provide you the care you need when and how you need it.
