This is not to say that insurance companies are evil or trying to take advantage of you. However, that being said, Insurance companies (even your own) are looking out for their own financial interests and the interest of their stock-holders, not yours.
When a call is made to an insurance company (such as if you or one of your family members calls an insurance company), almost always the caller receives the outgoing message that the call is being recorded for the purpose of quality assurance. However, even though the ‘purpose’ of recording the call is supposedly ‘quality assurance’, you are now put on notice that your call is being recorded (as required by California law).
And although it may seem like the adjuster you might speak with is friendly and seems reasonable, don’t be fooled. Things you say (or don’t say), or things you do (or don’t do) can and will be used against you.
As you speak with the Insurance company’s adjuster (or sometimes referred to as ‘file-manager’ to make it less obvious), it may even seem like the person you speak with is sympathetic to your injuries. You may even believe the person you speak with from the other side’s insurance company is ‘on your side’ and is likely to give you a good offer to compensate you without a fight. However, all too often the injured person talking with the insurance company is rudely introduced to the harsh reality that the insurance company (which may include your very own insurance company) is looking out for their own financial interest and the interests of their stock-holders, not yours. And what you thought was going to be a civil transaction, where you would receive a reasonable settlement, turns out to be a ridiculous ‘low-ball’ offer to you. And because of statements you’ve made (or failed to make), which can now be proven by recorded calls, and/or because of your actions (or your failures to act), you are left with no option other than having to accept their unreasonable offer where you unfairly do not receive the compensation you deserve.

A few initial concepts you should be aware of:
There are a few concepts that must be understood. First, injury to the ‘person’ is separate from damage to ‘property’. Second, although ‘pain and suffering’ is constantly shoved together, they are separate. With regard to injury to the ‘person’ the injured may be compensated for the ‘suffering’ s/he endures as a result of having ‘pain’ inflicted upon him/her. Additionally, if the injuries the injured person suffers require adjustments, corrections, or therapy to his/her physical body, you should be compensated for that as well. Furthermore, if the event was traumatic enough, the injured person may require psychological therapy as well. Also, if the injured person is forced to miss work as a result of the injuries, s/he may be compensated for that. There may also be existing medical bills and possibly future medical treatment that will need to be paid for. All of these factors must be taken into consideration if you are to be protected correctly.
